StarKist Found Guilty Of Underfilling Tuna Cans, Must Reimburse Customers In Free Tuna

As the result of independent testing conducted by an irate customer and a subsequent lawsuit, StarKist has been found to have underfilled a number of varieties of its five-ounce tuna cans.

Between February 2009 and October 2014, the company allegedly underfilled the following varieties: StarKist Chunk Light Tuna in Water, StarKist Chunk Light Tuna in Oil, StarKist Solid White Tuna in Water and StarKist Solid White Tuna in Oil.

Among the complaints levied against StarKist by plaintiff Patrick Hendricks is the accusation that the company was "unjustly enriched" by the sale of products that have been misrepresented to contain "an adequate amount of tuna for a five-ounce can." Testing found that the cans contained up to 17.3 percent less tuna than the legal minimum allowed for sale within the United States.
